Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AI Sales Employee (the “Service”), operated as the AI Sales Employee product (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

1. The Service

AI Sales Employee provides AI-assisted lead discovery, automated outreach, an AI phone receptionist, appointment scheduling, and a customer relationship management dashboard for trade and home-service businesses. Certain features (such as sending email or managing your calendar) require you to connect a third-party account, such as Google.

2. Your Account and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You are responsible for the accuracy of the business, customer, and lead information you provide, and for ensuring your use of the Service complies with applicable law, including laws governing telemarketing, commercial email (e.g. CAN-SPAM), and data protection with respect to your own customers and leads.

3. Google Account Integration

If you connect a Google account, you authorize the Service to access Gmail and Google Calendar solely to perform the features you enable — composing and sending email, reading reply threads, checking calendar availability, and creating, rescheduling, or cancelling calendar events on your behalf. You may revoke this access at any time from Settings or directly through your Google Account. Our handling of Google user data is described in our Privacy Policy.

4. Acceptable Use

You agree not to use the Service to send unsolicited, deceptive, or unlawful communications; to harass or defraud any person; to violate the rights of any third party; or to attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service. You are solely responsible for the outreach messages, calls, and communications sent through your account, including their content and recipients.

5. AI-Generated Content and Limitations

The Service uses artificial intelligence to draft outreach messages, respond to phone calls, and assist with scheduling. AI-generated content and responses may contain errors and are provided as a tool to assist you, not as guaranteed-accurate communications. Where the Service is configured to send messages, book, reschedule, or cancel appointments automatically, you are responsible for reviewing your configuration and for the outcomes of actions taken on your behalf. You should not rely on the AI receptionist or scheduling features for emergencies or time-critical situations without independent verification.

6. Third-Party Services

The Service relies on third-party providers, including Google, Anthropic, Twilio, Supabase, and Stripe, to operate. We are not responsible for outages, changes, or failures of these third-party services, though we will make reasonable efforts to maintain functionality and to notify you of material disruptions where practical.

7. Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons outside our control, including third-party service outages.

8. Intellectual Property

We retain all rights, title, and interest in the Service, including its software, design, and branding. You retain all rights to the business, customer, and lead data you input into the Service. You grant us a limited license to process that data solely to provide the Service to you.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if required by law. Upon termination, your right to use the Service ends, and we will handle any retained data as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT OR ACTIONS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PURPOSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Changes to These Terms

We may update these Terms from time to time. We will update the effective date above when we do, and for material changes we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
